The rules for the rest of this decade were quietly rewritten in late 2025 &mdash; and the new formula is less generous than the one it replaced.<\/strong><\/p>\n<p>The mechanism is simple to state and painful to absorb: where public pharmaceutical spending exceeds the statutory ceiling, the industry automatically repays the excess. It rests on Article 11 of Law 4052\/2012, with ceilings and adjustment rules in Article 25 of Law 4549\/2018 and rebates under Article 35 of Law 3918\/2011. Definitive calculation is made on a six-monthly basis.<\/p>\n<h2>What actually changed<\/h2>\n<p>A common misconception is that the 2022-2025 framework expired at the end of 2025 and left a gap. It did not. <strong>Law 5243\/2025 amended Article 25(2) of Law 4549\/2018<\/strong> so that for the years <strong>2023 to 2030<\/strong>, the permitted spending limits are adjusted <strong>solely by the projected annual change in real GDP<\/strong> as reflected in each year&#8217;s budget &mdash; and, specifically for each of the years <strong>2026 to 2030<\/strong>, the resulting limit is <strong>increased by a flat &euro;100 million<\/strong>.<\/p>\n<p>Compare that with what came before. The 2022-2025 arrangement provided escalating top-ups &mdash; rising year on year to &euro;400 million by 2025. The successor replaces that escalator with a flat &euro;100 million per year on top of GDP indexation. For companies modelling exposure to 2030, this is a materially different &mdash; and tighter &mdash; structure.<\/p>\n<h2>How the ceiling is divided<\/h2>\n<p>The annual allocation across categories &mdash; EOPYY hospital pharmaceutical spending on high-cost medicines, other EOPYY pharmaceutical spending, EOPYY health services and the hospital pharmaceutical spending of ESY hospitals &mdash; is set each year by joint ministerial decision. The formula is in law; the actual numbers are not, and they must be tracked annually.<\/p>\n<h2>The R&amp;D offset &mdash; and its catch<\/h2>\n<p>A joint ministerial decision of March 2026 set the terms for <strong>offsetting clawback against research, development and investment expenditure<\/strong> for 2026-2027, with a budget of &euro;150 million, administered through the General Secretariat for Research and Innovation. Projects must be completed by 31 December 2028, achieving at least 70% of both physical and financial targets.<\/p>\n<p>The catch is eligibility. As drafted, the offset is available to Greek parent companies subject to clawback &mdash; which excludes foreign multinational parents operating through Greek subsidiaries. Industry has objected publicly, both to that exclusion and to the feasibility of the deadline and the 70% threshold. If you are structured as a local subsidiary, check carefully before assuming you can benefit.<\/p>\n<h2>Other 2026 developments<\/h2>\n<p>From 1 January 2026 the Ministry of National Defence and NIMTS were brought inside the clawback and rebate mechanisms, with their own hospital pharmaceutical ceilings.
